Florida has a No-Fault Law that ensures a minimum amount of insurance benefits are paid regardless of who’s at fault. Florida’s No-Fault law mandates car owners to purchase an auto insurance policy that includes Personal Injury Protection (PIP) coverage with limits of $10,000 per person for medical and disability expenses, as well as $5,000 per person in death benefits.

The Personal Injury Protection (PIP) law (Florida Statute 627.736[1]) requires every auto insurance company writing PIP policies to pay 80% of all reasonable expenses for medical, surgical, e-ray and much more following an automobile accident (see your car insurance contract for more details).

The Florida Automobile Insurance Plan
Medical Payment is separate coverage from PIP and is optional on car insurance policies in Florida. PIP benefits will pay only 80 percent of the incurred medical expenses, while Medical Payment Coverage will pay the remaining 20 percent of your medical expenses. If the full $10,000 PIP benefit is paid out the Medical Payment Coverage will begin paying 100 percent of your incurred medical expenses until your coverage runs out.
